Apple sued for $1M over broken nose

An 83-year-old woman wants medical expenses plus punitive damages for inadequate warnings on the Long Island store's modern glass front.

An 83-year-old woman who broke her nose when she walked into the glass wall of an Apple store is suing the company for $1 million.

 

Evelyn Paswall wants $75,000 in medical expenses and the remainder in punitive damages, according to news reports.

 

At fault is the design of Apple's stores, attorney Derek T. Smith told the New York Post. "Apple wants to be cool and modern and have the type of architecture that would appeal to the tech crowd," he said. "But on the other hand, they have to appreciate the danger that this high-tech modern architecture poses to some people."

 

Paswall's suit states, "The defendant was negligent . . . in allowing a clear, see-through glass wall and/or door to exist without proper warning," says CBS New York. (Post continues below.)

Identifying Paswall as "a former Manhattan fur company vice president," Financial Express says she was headed for the store to return an iPhone on Dec. 13, but didn't realize she was approaching a wall of glass.

 

Mashable says Apple places warning stickers on its glass-fronted retail stores, but Smith said there were no -- or inadequate -- markings on the glass at the Manhasset, N.Y., store where the accident occurred.

 

And lest anyone jump to the conclusion that the octogenarian's eyesight may have been to blame, she assured the New York Post: "I may be elderly, but I'm very active, and I'm still driving too!"

Maybe it was the Windex that made the glass invisible - like the commericial where the crow hits the glass after it's cleaned with Windex.

She needs to make sure to stop at McDonalds for a hot cup of coffee, too. Maybe she shouldn't use the phone while walking. Can we get a law for that passed?

For 83 year old she is moving very fast.. Fast enough to run into glass door and broke her noise.
